Insurance Regulations

There are regulations in each state that require that all group policies include certain services – each state creates it’s own regulations, which means that policies sold in one state may include state-mandated services, while these same services are contract exclusions on policies sold by the same company in a neighboring state.

To make things even more complicated, if you work for a company with offices in more than one state, your insurance policy could be regulated by the laws in a state other than the one where you live. For instance, you could live in Oregon, but have a group policy that is regulated by the laws of Georgia. And some self-funded groups fall under completely different regulations.

In the 2003-2004 legislative session, the Louisiana legislature considered Senate Bills 409 and 660, which would have mandated the offering of optional insurance coverage for the treatment of morbid obesity. Neither bill made it to the floor of the legislature for a vote, because strong interest groups, including the NFIB, rallied to defeat the measures in committee. A similar bill was also defeated in Georgia.

Each time a state legislature requires employers to offer coverage for specific procedures, the cost of the premiums go up. This increases the cost to the employers who purchase the health insurance policies for their employees, and it reduces their profits. Businesses organize opposition to almost all legislative mandates for health insurance, and usually win.

At this time I am unaware of any state that requires group insurance policies to include coverage for gastric bypass surgery.
